These Terms of Sale apply to all purchases made by consumers (B2C) via https://bspshop.com.

By placing an order, you agree to these terms.

1. Scope

These terms apply to all consumer purchases made through our website.

2. Products

Our products include both standard items and custom-made products.

Custom-made products include, but are not limited to:

  • wheelchair spoke guards
  • wheelchair trays (including illuminated trays)

Custom products are manufactured based on customer specifications and are treated differently under EU consumer law.

3. Prices and Payment

All prices are displayed in EUR and include VAT where applicable.

Payment can be made via:

  • Shopify Payments
  • PayPal
  • Invoice (where agreed)

We reserve the right to refuse or cancel any order.

4. Delivery

Shipping costs are calculated at checkout.

We may offer free shipping depending on the order value and delivery region. We reserve the right to apply or withdraw free shipping at our discretion.

We do not ship to:

  • Iran
  • North Korea
  • Russia
  • Belarus

For deliveries outside the EU, import duties and taxes are the responsibility of the customer.

Risk of Loss (Consumer Sales). In accordance with Article 20 of Directive 2011/83/EU, the risk of loss or damage to the goods passes to the consumer only when the consumer (or a third party indicated by the consumer, other than the carrier) has acquired physical possession of the goods. If a shipment is lost or damaged in transit, please contact us at info@bspshop.com and we will resolve the issue, including by replacing the goods or refunding the purchase, where appropriate. Where the consumer has independently chosen and arranged a carrier not offered by us, the risk passes upon delivery to that carrier.

5. Right of Withdrawal (EU Consumers)

For standard (non-custom) products, consumers have the right to withdraw from the purchase within 14 days in accordance with EU law.

Custom-made products are excluded from the right of withdrawal under Article 16(c) of Directive 2011/83/EU.

This means that custom products cannot be returned or refunded once production has started.

6. Returns

Standard products may be returned within 14 days if unused and in original condition.

Custom-made products cannot be returned unless there is a verified defect.

7. Defect Warranty (Custom Products)

For custom-made products, we provide a 30-day defect warranty.

To submit a claim:

  • you must contact us within 30 days of delivery
  • you must provide clear photos and description of the issue

We will review the claim and decide, at our reasonable discretion, whether the product qualifies as defective.

The review process does not extend the 30-day claim period.

8. Warranty (Standard Products)

For standard products, warranty is provided in accordance with applicable EU consumer laws.

9. Order Cancellation

Orders may be cancelled:

  • for custom products: only before production has started
  • for standard products: before shipment

Once production or shipment has started, cancellation is no longer possible.

10. Use of Products

Products must be used in accordance with provided instructions and in a reasonable and intended manner.

We are not responsible for damage caused by improper use.

11. Liability

To the maximum extent permitted by law:

We are not liable for any indirect or consequential damages, including loss of profit or business interruption.

12. Errors and Availability

We reserve the right to cancel or modify orders in case of:

  • pricing errors
  • product description errors
  • availability issues

13. Online Dispute Resolution (EU Consumers)

The European Commission provides an Online Dispute Resolution (ODR) platform for resolving disputes arising from online purchases. You can access it at: https://ec.europa.eu/consumers/odr

We are, however, not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board, and currently do not do so. Customers are encouraged to contact us first at info@bspshop.com so that we can attempt to resolve any concerns directly.

14. Governing Law

These Terms are governed by the laws of the Netherlands.
